“Are you recording me? Do you have permission to record me?” asks the woman carrying a Trump flag at the Phoenix airport. She then smacks the phone from the hand of the woman recording her only to be promptly arrested by local authorities.
The busy Thanksgiving travel season is upon us with millions of Americans taking to the skies. Airports are busy and tensions remain high. One passenger, however, felt it was the perfect time to walk around with a Trump flag. After (allegedly) being recorded by a fellow traveler, the woman smacks the phone from the hands of the person she accused of recording her.
Literally seconds after this occurs, local police enter the frame. The male police officer dryly observes, “Well, you don’t have permission to smack people’s hands,” before leading her away.
The video was posted to TikTok by @jennirocha86 who noted that her cousin had sent this to her.
Arizona is a one-party consent state for recording, however, we are not lawyers so we are not making a judgment on the applicability of said rules to this situation.

Wow, the police spend their time arresting a person who smacked someone’s hand away? Tough love. I wonder if she’ll get prison time while true criminals are all over causing chaos like the ATL shooter. I don’t think it’s very polite to video other people without their permission even if it’s legal. Just ask all the first amendment auditor types on TikTok or YouTube.
But slapping someone and knocking an expensive smart device(personal property) across the floor is an ok response? I am glad the airport security was on it. There is no way that person would sit quietly on a plane wearing their mask. She wanted attention because she was wearing that flag. She got it.

I am actually a lawyer. One party state doesn’t even enter into it as you have no expectation of privacy at an airport or any other public space. The consent rule only applies to non-public areas and conversations. For example, if you call me on the phone from an airport in a 2 party state, I can’t record it, but literally everyone in the airport could.
Slow news day?
The person carrying the flag and smacking the phone is a black anti-Trump woman. She tore the Trump flag down, then got pissed that a white woman recorded her doing it. You can plainly see this.
We are liberals. Fact checking articles would be detrimental to our cause. Besides, we don’t care about the truth, only the message.
She was probably mad that American Airlines wouldn’t upgrade her to Main Cabin Extra for free.
BTW- Doe anyone know if she missed her flight?
